Terms and Conditions

These General Terms and Conditions govern the contractual relationship between Mad Beauty Shop GmbH ("Mad Beauty Shop" or "www.madshop.ch") and its customers. They apply to all orders, deliveries, and other services via the online shop madshop.ch. By placing an order, the customer acknowledges these terms as binding.

1.Scope / General

The online shop madshop.ch is operated by Mad Beauty Shop GmbH. These General Terms and Conditions apply to all services and deliveries provided or offered via madshop.ch. The offer is directed at customers residing in Switzerland, the Principality of Liechtenstein, and all European countries where delivery is possible.

By placing an order, the customer accepts these General Terms and Conditions. Changes can be made at any time and become effective upon publication on madshop.ch.

2.Products and Offers

Mad Beauty Shop GmbH reserves the right to refuse orders without stating reasons.

If the ordered goods are not available in the desired quantity or at the stated price, Mad Beauty Shop GmbH will inform the customer. In this case, the contract will only be concluded when the customer expressly confirms the changed conditions in writing.

By placing an order, the customer makes a binding offer. Mad Beauty Shop GmbH accepts this offer by sending the delivery note; the contract is thereby concluded.

When completing the order, the statutory value-added tax (VAT) is shown separately and charged in the shopping cart.

3.Prices

The current prices are published on madshop.ch. The prices valid at the time of the order are decisive. In the event of obvious pricing errors, madshop.ch reserves the right to adjust prices even retrospectively; the customer will be informed immediately and is not obliged to purchase the affected products.

In addition to the product prices, shipping costs apply depending on the chosen shipping method. For orders over CHF 100 (after deductions and promotions), madshop.ch covers the shipping costs. This does not apply to surcharges for special shipping methods such as A-Post Signature.

4.Registration

Registration is exclusively reserved for natural persons with full legal capacity. By placing an order, the customer confirms to be at least 18 years old, to have legal capacity, and not to be under guardianship. There is no right to access the online shop. The information provided during registration must be complete, truthful, and kept up to date.

5.Order / Conclusion of Contract

An order becomes binding as soon as the customer clicks "Place Order" on the order summary, thereby making a binding offer to conclude a purchase contract. If ordered goods are not available, the customer will be informed immediately and an individual solution will be agreed upon (replacement delivery, refund, or later delivery).

6.Delivery

The customer is responsible for a complete and correct delivery address. In the event of an incorrect or incomplete address, delivery may be withheld; madshop.ch is entitled to retain the delivery without compensation. All delivery times are non-binding and approximate. Mad Beauty Shop GmbH assumes no liability for delays outside its control (force majeure, traffic, weather, public holidays); such delays do not entitle the customer to withdraw from the contract or claim damages.

7.Transfer of Risk

The risk of loss, damage, or destruction of the goods passes to the customer upon handover to the shipping service provider, regardless of who bears the shipping costs.

8.Payment Methods

The following payment methods are accepted:

• Credit card (Visa, Mastercard, etc.)
• TWINT
• PayPal
• Prepayment: The invoice will be sent by e-mail; the goods will only be dispatched after full payment has been received.

9.Retention of Title

The delivered goods remain the property of Mad Beauty Shop GmbH until the purchase price has been paid in full. Before the transfer of ownership, pledging, collateral assignment, processing, or alteration is not permitted without express consent.

10.Returns & Revocation

We grant a right of return within 14 days of receipt of the goods; the postmark is decisive. Returns are only accepted if the products are undamaged, unused, unopened, and in their original packaging. Products that are not suitable for return for health protection or hygiene reasons (e.g., opened cosmetics) are excluded. We cover the return costs if a free return label is requested in advance via info@madshop.ch or by phone at 044 311 25 25. The customer must check the goods immediately upon receipt; complaints must be reported within 5 working days of delivery at the latest, otherwise the goods are deemed approved and free of defects. Returns or exchanges due to dislike or incorrect ordering are excluded. Cancellations are only possible by individual arrangement.

11.Shipping Partner

The ordered products are usually delivered with Swiss Post. Depending on the destination, another carrier may be used. Return address: Mad Beauty Shop GmbH, Badenerstrasse 727, 8048 Zurich, Switzerland.

12.Weight

The customer accepts that delivered products may have slight weight deviations compared to the stated weights. Such slight deviations do not constitute a defect and do not entitle the customer to return the goods or to a price reduction.

13.Warranty

The warranty conditions of the respective product suppliers apply. Mad Beauty Shop GmbH does not provide any additional warranties. In the event of a warranty claim, the customer contacts madshop.ch to clarify the procedure; the decision on the type of warranty service lies with the supplier, for devices, a repair is usually checked first. Warranty services are not transferable. Damage due to improper handling, normal wear and tear, or external influences is excluded.

14.Data Protection

The handling of personal data within the framework of using the online shop is governed by our privacy policy, which can be viewed on the website at any time.

15.Liability

Mad Beauty Shop GmbH excludes all liability for damages, unless mandatory legal provisions dictate otherwise. No liability is assumed for direct or indirect damages, including consequential damages, caused by a product, particularly through improper use, malfunction, or failure. No liability is assumed for theft or loss of items.

16.Intolerances or Allergies

Mad Beauty Shop GmbH assumes no liability for any allergic reactions or intolerances. It is the customer's responsibility to check the ingredients before purchase and to consider individual allergies or intolerances.

17.Applicable Law and Jurisdiction

Swiss law applies exclusively. The exclusive place of jurisdiction for all disputes is Zurich, Switzerland.
